Shiva’s Gold and Gems offers this website, including all information and services available from the site to you conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. 

Any change or modification will be effective immediately upon posting of the revisions on the site. Your continued use of the site following the posting of its changes or modifications will constitute your acceptance of such changes or modifications. Therefore, you should frequently review these Terms and Conditions and any other applicable policies from time-to-time to understand the terms and conditions that apply to your use of the site. If you do not agree to the amended terms, you must stop using the site.

Product Availability and Pricing
If you’re interested in a piece that is currently on back order, call or email us and we can tell you when the item will be back in stock. We are more than happy to contact you to discuss possible options regarding any piece of interest.
Data, including prices, may be inaccurately displayed on our site due to system or typographical errors. While we make every attempt to avoid these errors, they may occur. We reserve the right to correct any and all errors when they do occur, and we do not honor inaccurate or erroneous prices. If a product’s listed price is lower than its actual price, we will, at our discretion, either contact you for instructions before shipping the product or cancel the order and notify you of such cancellation. If the order has been shipped, you agree to either return the product or pay the difference between the actual and charged prices. Our prices are also subject to change without notice. Diamond Certificate
Most of all our loose diamonds come with either a GIA or EGL certification. These grading reports are detailed documents created by diamond grading experts at one of two highly-respected diamond laboratories – making it very expensive to replace a diamond grading report. Because of this, we require each diamond grading report to be included with each returned diamond. If you do not include the diamond grading report with your return, we will be unable to accept the return and provide you with a refund.

Information on Our Site
Shiva’s Gold and Gems makes every attempt to ensure that our online catalog is as accurate and complete as possible. In order to give you the opportunity to view our products in great detail, some products may appear larger or smaller than their actual size in our photographs; and since every computer monitor is set differently, color and size may vary slightly.

Validation Checks
All credit, debit, and charge card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery. In addition, in the interests of preventing fraudulent use of credit, debit and charge cards, will validate the names, addresses and other information supplied during the order process against commercially available records (e.g Electoral Roll data, Credit Reference Services). A third party may also be instructed to complete these checks. 

By ordering from the Shiva’s Gold and Gems website you consent to such validation checks. We may need to contact you by letter, telephone or email to verify details before we are able to process and dispatch your order, or we may be unable to accept your order. Any information given may be disclosed to a registered Credit Reference Agency which may keep a record of the information. All information provided will be treated in accordance with the Data Protection Act 1998. These measures are taken as extra protection for you, to ensure your online shopping experience with us is as safe and secure as possible.

Orders
Once you have completed an online purchase, we will send you an email confirming your order details. When your order is placed, the funds for your order will be ‘pending’ ready for us to ‘collect’ when we dispatch your order. Pending funds means the amount of authorised money is set aside, away from your available balance and the amount is not debited completely until the day of dispatch. Goods will not be dispatched until payment collection has been successful. While we are under no obligation to accept your order, we would normally do so when:
(1) The product is available
(2) The order reflects current pricing
(3) Your credit card/debit card payment is approved by your credit card/debit card company
(4) Your order passes our verification checks

We cannot accept orders from persons under the age of 18 and are unfortunately unable to accept PayPal payments or Interest Free Credit applications over the telephone.
All orders received online are processed and, depending on stock availability, are dispatched as promptly as possible and normally within 1 to 5 working days of receiving the order. If the items you have ordered qualify for Express Delivery, they will normally be dispatched within 1-2 working days. Where any products have a longer delivery time of 48 hours, our customer experience team will contact you by email to confirm the approximate date of dispatch.

Returns and Refunds
Shiva’s Gold and Gems appraisal policy allows for clients to take jewelry pieces home, have them appraised, and send payment after satisfaction. If for any reason clients are not satisfied, pieces are able to be returned with a 100% money back guarantee.

Please note that to be eligible for return and Shiva’s money back policy, items must be in their original purchase condition including all product documentation. Returns and refunds are only applicable to jewelry and diamonds and not any timepieces sold by Shiva’s Gold and Gems.

Modification and Notice
Your agree that Shiva’s Gold and Gems may modify these Terms and conditions and any other policies on our site at any time and that posting the modified Terms and Conditions or policies on our site will constitute sufficient notice of such modification.

Termination
Notwithstanding any of these Terms and Conditions, Shiva’s Gold and Gems reserves the right, without notice and in sole discretion, to terminate your license to use this site, and to block or prevent your future access to an use of this site.

Severability
If any provision of these Terms and Conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed several from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.
